Please read these Terms of Service (“Agreement”, “Terms of Service”) carefully before using http://www.groclinics.co.nz/ (“the Site”) operated by Gro Clinics (Online) Pty Ltd (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the Site at http://www.groclinics.co.nz/.
By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. Capitalized terms are defined in this Agreement.


Who are we?

Gro is a health care platform that provides access to hair care and hair loss treatments. The Gro offering includes but is not limited to; Everyday products (over the counter) through the online store, the Gro facilitation service (outlined below), and in-clinic procedures provided by a registered Australian Doctor in one of our physical Gro Clinics locations in Australia.
The Gro Facilitation Service facilitates confidential consultations with Australian registered doctors (Doctors) and health practitioners such as pharmacists (Practitioners)
Our website content and any communications you have with Gro representatives (other than Doctors and Practitioners) do not constitute medical advice. You should always obtain medical advice from a Doctor or your regular doctor to ensure any particular medication or treatment is suitable and safe for you.


User account

You must become a registered user in order to make orders or attend consultations with Doctors or Practitioners through the Gro facilitation service. Each user is permitted to create a maximum of one registered user account (Account). You should not register an account on behalf of anyone other than yourself. Registered users must (1) be over 18 years old, (2) be resident in Australia, (3) be capable of entering a legally binding agreement with Pilot and (4) agree to these Terms and Conditions.
When you register and activate your account, you will provide us with personal information such as your name, gender, email address, telephone number, date of birth and shipping address. This information will enable the Doctors and Practitioners to conduct their consultations. It is your responsibility to update this information so it is current, complete and accurate. We will handle all personal information we collect in accordance with our Privacy Policy. You consent for us to contact you by email or phone if and when the need arises using the email address and phone number you provide when creating your account on the Gro platform.
When you register your account, you will also be required to create a password. You are responsible for keeping this password secure and are responsible for all use and activity carried out under your account. If you suspect, or become aware of, any unauthorised use or misuse of your account or any other breach of security in relation to your account, you must notify us immediately and take immediate steps to re-secure your account (including by changing your password).
You agree that all information provided to Gro, the Doctors and Practitioners will be true and complete to the best of your knowledge and that you will not purposefully omit to provide any information that could reasonably be judged to be potentially relevant to the Doctors and Practitioners in conducting their consultations. It is also your responsibility to inform your existing doctor of any medicines the Doctors prescribe for you.


Gro facilitation service

Gro takes no responsibility and makes no warranties, express or implied, in relation to the content of any consultation between you and the Doctors or Practitioners through the Gro facilitation service. You and the Doctors or Practitioners are responsible for the conduct of the consultation and all information or communications made.
The Doctors and Practitioners take exactly the same personal responsibility for you as they would if they were seeing you in person. The Doctors and Practitioners will make notes of their consultation with you and it is their responsibility to hold and maintain your records as required by law. Gro may from time to time hold copies of notes made by the Doctors or Practitioners.
Gro does not guarantee that an online consultation is the appropriate course of treatment for your particular health care problem. This assessment will be made by the Doctors and Practitioners. You agree to contact your own doctor immediately should your condition change or your symptoms worsen. If you require urgent care, you should contact your local emergency services immediately.
Gro is not a pharmacy and therefore does not dispense any medicines. As part of the Gro Facilitation Service, Gro will find a suitable pharmacy that is capable of providing the medicines prescribed by the Doctor. You can fulfil your script through a pharmacy of your choice upon request.


Purchases – Gro facilitation service and the compound pharmacy

As part of the services provided through the Gro Facilitation Service, Gro acts as an agent for the suitable pharmacy to facilitate the payment processes and management of orders/prescriptions. You may purchase a subscription through the Gro platform made available after the Doctor consultation. All subscriptions automatically renew unless cancelled at least 5 days before the next billing date or subsequent subscription period.
You will be charged the subscription price either at the time a checkout is completed or after your consultation with the Doctors or Practitioners. All subsequent charges will occur on a monthly basis thereafter, as appropriate, unless cancelled by giving us at least 5 days’ notice before your next billing date or subsequent subscription period. Subject to any additional rights you may have at law (including under the Australian Consumer Law), the subscription price will be refunded only if:

  • a Doctor declines the request (the decision to approve or reject a request is at the Doctor’s absolute discretion);
  • a Practitioner declines the request (the decision to supply a request is at the Practitioner’s absolute discretion);
  • an item you have ordered is out of stock; or
  • a product or pricing error is identified.

All charges and prices as shown on our website are in Australian Dollars and inclusive of GST where applicable and delivery charges.
You expressly authorise Gro to process the payment for the subscription price via your relevant payment method at the time a checkout is completed or after your consultation with the Doctors or Practitioners. We may, upon written notice to you, change the price for your current subscription, to take effect the next time you renew your subscription.

By agreeing to the terms and conditions outlined on this page, you are agreeing to the following:

I acknowledge that this is a third party referral service that is independent and separate from Gro and that Gro is in no way liable for compounding pharmacies and third party companies. I agree for my order for a particular product to be placed by Gro to the compounding pharmacy on my behalf, and for the product to be posted directly to my address from the compounding pharmacy. I acknowledge that Gro takes my payment on behalf of the pharmacy for my convenience only and is not a party to the transaction. I hereby consent to Gro emailing my health, prescription and order information to the compounding pharmacy, if requested, to meet their legal requirements. If I do not consent to my health information being sent to the pharmacy, I will advise Gro immediately. I acknowledge that Gro does not take any responsibility for errors associated with the pharmacy, including the delay in postage or lost deliveries.

Purchases – Everyday products

Certain products or services may be available exclusively through our online store. These products may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colours/size and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.
We reserve the right but are not obligated, to limit the sales of our products to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product made on this site is void where prohibited.
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.


Accessing and correcting your personal information

You can contact us using the information below to access the personal information we hold about you. On rare occasion, we may not be able to provide you with access to all of your personal information and, where this is the case, we will provide you with written notice stating our reasons. We may also need to verify your identity when you request your personal information.
If you think that any personal information we hold about you is inaccurate, please contact us and we will take reasonable steps to ensure that it is corrected.



If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We reserve the right to modify this privacy statement at any time, so please review it frequently. If we make material changes policy, we will notify you here, by Email, or by means of a notice on our homepage.

The liability for the actions of Doctors and Practitioners, including advice provided and prescriptions facilitated through the Gro Facilitation Service, rests solely with those third parties providers. All Doctors and Practitioners are solely responsible for the patient’s care.
